“Don’t demean the Hindu society structure,” the court stated. “Every community has its own evolution, and it must be understood in context rather than judged through a narrow lens.”
The remarks came during deliberations on a petition challenging certain customary practices, where the petitioner’s counsel used language that the bench found to be unnecessarily critical of Hindu social traditions. The court emphasized that while constitutional values must guide legal interpretation, cultural heritage should not be vilified in the process.
The bench further noted that India’s pluralistic society is built on a tapestry of diverse customs and beliefs, and that judicial scrutiny must be balanced with respect for cultural identity. “We must not allow modern legal reasoning to become a tool for cultural erasure,” the justices added.
